# Schools hiring temp workers to be substitute teachers

Some schools have begun to hire contract workers to serve as substitute teachers. One such school district in Bethlehem, Penn., is [considering the move](http://www.lehighvalleylive.com/breaking-news/index.ssf/2014/01/lehigh_valley_districts_consid.html) to avoid vacancies when the total number of empty spots in the school district exceeds the number of available substitute teachers.

It's also a great way for schools to cut down on expenses having to do with Affordable Care Act requirements. Typically, any business with more than 50 employees must provide insurance to any workers who have weekly schedules of more than 30 hours. But schools have different rules about hours, according to the article, and this can make things complicated when it comes to substitute teachers.

Hiring an [employer of record](https://www.innovativeemployeesolutions.com/recruiter-staffing/employer-of-record) to take this burden off the school is a great way to have excellent staff without the added expenses of Affordable Care Act compliance. According to Paul Muratore, CEO of Talent Partners, hiring temp workers [can be a grey area](http://adage.com/article/guest-columnists/affordable-care-act-means-freelancers/290926/) under the Affordable Care Act. It is the responsibility of the employer to keep track of the hours worked, and the government will look to the employer to see if a penalty is due for not offering health care.

By shifting that burden to another company, this problem can be avoided.
